The landmark judgment by the Supreme Court on informed consent to medical treatment has been explored in an article by the Faculty’s Andrew Smith, QC, in the prestigious BJOG International Journal of Obstetrics and Gynaecology.

Mr Smith appeared in the case of Montgomery v Lanarkshire Health Board which the background to his article describes as “without doubt the single most important case to have been decided in the past 30 years for those involved in medical negligence cases and the practice of medicine.” The implications of the ruling, it adds, “have been international.”

A second article, which Mr Smith has co-authored with several doctors, is due to be published by the BMJ, the international peer reviewed medical journal.
