Biography

Fergus Whyte is a civil litigator with a varied background and experience in areas including commercial and contractual disputes, media law, privacy and defamation, intellectual property and information technology, and trust law.

Fergus qualified as a barrister and solicitor in New Zealand in 2012. He was a judges’ clerk (judicial assistant) and then a barrister and solicitor in private practice. He has appeared in court as both junior and sole counsel in the High Court of New Zealand (equivalent to the Outer House). Since qualifying in Scotland he has appeared as sole counsel and as a junior in the Inner House, in an international arbitration as well as appearing as counsel in various Sheriff Courts and the Sheriff Appeal Court. He appears as both sole and junior counsel in the Commercial Court of the Court of Session.

Following a LLM at the University of Edinburgh, he completed the Faculty’s examinations in Scots Law before commencing devilling in 2019. He has acted as a tutor in law at the University of Edinburgh and as a mooting coach. He is an associate member of the Chartered Institute of Arbitrators. He speaks French and Spanish and has experience in cross-border disputes.
