Buying an insolvent business raises many difficult issues for the purchaser. This new conference will concentrate on the key legal issues that arise and how best to deal with them.
After attending this conference delegates will:
- understand the most important legal issues concerning heritable property when purchasing an insolvent business
- understand how the sale of a business is structured by an IP and what terms and conditions may find favour
- understand the difference approach to the purchase of a solvent and insolvent business
- know some alternatives to warranties
- understand the rights of key third parties in an insolvency
- understand the framework of the TUPE Regulations and when TUPE will apply in the transfer of an insolvent business
- know more about how to handle aTUPE consultation
- understand the particular issues in dealing with the transfer of employees from an insolvent business
Speakers:
Mr Graham Bell is a Partner in Wright Johnston & Mackenzie’s Business Recovery and Insolvency Group. Graham specialises in insolvency related corporate advice and business transfers related to insolvency- both acting for and buying from insolvency practitioners. He has been a Law Society Accredited Specialist in Insolvency for more than 15 years.
Mr Liam Entwistle is head of Wright Johnston & Mackenzie’s award winning Dispute Resolution Group. A veteran of the gamut of workplace disputes, he is an Accredited Workplace Mediator and specialises in resolving conflict so businesses can get on with their financial lives. In particular he has advised on the impact of TUPE in both large and small transfers, and focussed on practical answers to the questions posed by the regulations.
